How to Get a Divorce in Missouri If a Husband Cheated
- 1). Contact a lawyer. This does not mean you will have to hire someone, but look into your options. Lawyers can often provide insight to the process specific to your case.
- 2). File the paperwork for divorce within the county you reside. You must be a resident of Missouri for at least 90 days prior to filing. The paperwork can be filed in the county where either party lives if you are currently living separately.
- 3). Wait for the papers to be served to your spouse. At this point, your spouse will either deny the marriage is irrevocably broken or accept the claim at which point the proceedings move forward. If the other party denies the petition, you will need to file a response.
- 4). File your response with proof the respondent committed adultery. This is not a criminal court thereby the burden of proof is significantly less. Photographic evidence is the strongest, but you can also produce phone records, emails, text messages or witnesses.
